For what purposes and on what legal basis is my data processed?

We process your personal data for the initiation, execution, and termination of your employment or deployment as a temporary worker. The primary legal basis for processing your personal data is Art. 6 Para. 1 lit. b GDPR in conjunction with § 26 Para. 1 BDSG. If necessary, we process your personal data to fulfill legal requirements according to Art. 6 Para. 1 lit. c GDPR or on the basis of your consent according to Art. 6 Para. 1 lit. a GDPR in conjunction with § 26 Para. 2 BDSG. The processing of special categories of personal data (e.g., health data) is based on your consent according to Art. 9 Para. 2 lit. a GDPR in conjunction with § 26 Para. 2 BDSG, unless legal permissions such as Art. 9 Para. 2 lit. b GDPR in conjunction with § 26 Para. 3 BDSG are applicable.

Who receives my data and is there a transfer to third countries?

Recipients of your personal data are the persons and departments that require it for the initiation, execution, and termination of the employment relationship. For the execution of your deployment as a temporary worker, we pass on your necessary personal data to your employer. In case of a corresponding legal obligation, we pass on your personal data to those authorities and public bodies that require it in the context of the initiation, execution, and termination of your employment or deployment as a temporary worker (e.g., the health insurance company you specified). We pass on your personal data to the company doctor based on our legal obligation for health prevention. With your consent, we pass on your personal data for the purpose of implementing company pension schemes to the respective entities. Your personal data will be passed on to external service providers on a case-by-case basis. Legal or contractual regulations for the protection of your personal data apply here. There is no transfer of your personal data to a third country or an international organization.

How long will my data be stored?

We store your personal data beyond the duration of the employment relationship or deployment as a temporary worker, in accordance with legal retention periods. These arise in particular from the Commercial Code and the Fiscal Code. If an employment relationship does not result from the application process, we delete your personal data after 6 months, unless longer storage is necessary for the defense of legal claims.

Am I obligated to provide my data and what are the consequences of not providing it?

As part of the application process, we ask you to provide complete information. Incomplete application documents may not be considered.

For the initiation, execution, and termination of the employment relationship or deployment as a temporary worker, you are required to provide the necessary personal data. If you do not provide the required personal data, we may not be able to enter into or continue an employment relationship with you.

What data protection rights do I have as a data subject?

You have the right to access (Art. 15 GDPR), correction (Art. 16 GDPR), deletion (Art. 17 GDPR), restriction of processing (Art. 18 GDPR), and data portability (Art. 20 GDPR). You have the right to withdraw a given consent to data processing at any time. Withdrawing consent does not affect the lawfulness of processing based on consent before its withdrawal.

If we process your personal data based on our legitimate interest or for direct marketing purposes, you have the right to object to the processing (Art. 21 GDPR).

Where can I file a complaint?

You have the option to file a complaint with the aforementioned data protection officer or with the competent data protection supervisory authority, the State Commissioner for Data Protection and Freedom of Information Baden-Württemberg, Lautenschlagerstrasse 20, 70173 Stuttgart.
